Terms of service

These terms govern your use of TurboProc Scope, our expert AI procedure optimization tool, available on the Apple App Store. By downloading TurboProc Scope from the App Store, you agree to these terms.

"We" / "us" / "TurboProc" means TurboProc, the company providing the service. "You" means the individual or entity using the service. "App" means TurboProc Scope, available for download on the Apple App Store.

1. How access works

TurboProc Scope is available on the App Store. The app meters AI Optimization Reports, the structured analyses it generates from a session, and the executive summaries that combine several sessions. It starts with a trial: a one-time welcome allowance of AI Optimization Reports when you first start. After the trial, a subscription is required to keep generating reports: FAST is $99 per month for 20 AI Optimization Reports per month, and FASTER is $399 per month for unlimited reports per month. Both are monthly auto-renewing subscriptions. Reports you generate beyond your plan's allowance are still saved on your device but remain locked from viewing until you subscribe or upgrade. Subscription names, pricing, billing cadence, and renewal terms are also displayed in the App Store and inside the app before you purchase.

Subscriptions are billed through Apple in-app purchase. Payment is charged to your Apple ID at confirmation of purchase. A subscription automatically renews at the then-current price unless auto-renew is turned off at least 24 hours before the end of the current period; your Apple ID is charged for the renewal within the 24 hours before the period ends. You can manage or cancel your subscription at any time in your Apple ID account settings; cancellation takes effect at the end of the current billing period.

We may add, remove, or change subscription tiers, pricing, and the included monthly AI Optimization Report allowances. For a change that affects an active subscriber's plan, price, or allowance, we will give at least 30 days' notice (for example, by email or an in-app notice) before it takes effect for that subscriber, and the change will not affect a period you have already paid for. Continuing your subscription after a change takes effect constitutes acceptance of it.

4. Intellectual property and license

TurboProc and its licensors own all intellectual-property rights in TurboProc Scope — the application, its software, AI models and prompts, user interface and designs, and the "TurboProc" and "TurboProc Scope" names and logos. Subject to these terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use TurboProc Scope on Apple-branded products you own or control, as permitted by the Apple Media Services Terms and Conditions, for your own or your employer's internal business use. You may not copy, modify, translate, reverse-engineer, decompile, disassemble, rent, lease, resell, sublicense, or create derivative works of the app, except to the extent applicable law prohibits that restriction. We reserve all rights not expressly granted.

We claim no ownership of the SOPs, video, or analysis you create or capture with the app; those remain yours, handled as described in Your data below and in the privacy policy.

Use the app to analyze lines, shifts, and SOPs that you (or the company you work for) have the right to record. Specifically:

Video you capture in TurboProc Scope, and the per-step analysis the app produces from it, stay on your device. You control whether they are kept, exported, or deleted, all from inside the app. We do not store, transmit, or process that content on our servers. Your account profile, subscription and app-usage events, and install/attribution identifiers, by contrast, are collected and stored on our servers as set out in the privacy policy. 7. Termination

Either side can end the service relationship at any time, for any reason. If we end it, we give you 30 days to export your data. If you end it, your data is removed within 30 days of your request (subject to the retention windows in the privacy policy). Subscription users: cancellation ends auto-renewal; access continues through the end of the paid period.

8. Disclaimers

The service is provided "as is". We make no warranties of any kind, express, implied, statutory, or otherwise, including warranties of fitness for a particular purpose, non-infringement, or uninterrupted availability. The output TurboProc Scope produces is a recommendation; the decision to act on it on your line is yours.

TurboProc Scope is not a safety system. Do not use it to make safety-critical decisions (e.g., whether to keep a worker at a station, whether to halt a line). Use your existing safety processes for those.

9. Limitation of liability

To the fullest extent permitted by law, TurboProc's total liability arising out of or related to your use of the service is capped at the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) $100. We are not liable for indirect, incidental, special, consequential, or punitive damages, lost profits, or lost data.

10. Indemnification

To the fullest extent permitted by law, you will indemnify, defend, and hold harmless TurboProc and its officers, employees, and agents from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of TurboProc Scope; (b) the procedures, footage, or content you record or process with it; (c) your breach of these terms, including the Acceptable use section; or (d) your violation of any law or of any third party's rights, including privacy, publicity, employment, recording-consent, or intellectual-property rights. We may participate in the defense of any such claim with counsel of our own choosing at our own expense, and you will not settle any claim in a way that imposes an obligation on us without our prior written consent.

11. Governing law

These terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws principles. Any dispute that can't be resolved by good-faith conversation is subject to the exclusive jurisdiction of the state and federal courts located in Santa Clara County, California.

12. Changes

If we materially change these terms we'll email you with at least 14 days' notice and post the new version here. Continued use of the app after the change takes effect constitutes acceptance of the updated terms.
